JUSTICE DINESH KUMAR SINGH ORAL ORDER 11-12-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 3 (I) (II), 3(I)(X) of the SC/ST (Prevention of Atrocities) Act.

It is alleged that petitioner no.1 is the owner of petroleum dealership and petitioner no.2 is the manager of the same. The case of the informant is that he paid `40,000/- as earnest money for opening tea stall in the premises of petroleum dealership on monthly rental of `2,000/-. But after receiving money the petitioners did not provide the space for opening tea stall and the informant was abused by calling caste name. It is submitted by learned counsel for the petitioners that in the premises of petroleum dealership the petitioners are not authorized to allow anyone to open any tea stall. There is nothing

Patna High Court Cr.Misc. No.56428 of 2015 (2) dt.11-12-2015 2/2 on record to suggest that the money was paid to the petitioners. The Money Suit No. 20 of 2013 has also been filed by the informant which is pending.

It is submitted by learned Special P.P. that the chargesheet has been submitted and cognizance has been taken. Considering the genesis of the accusation and money suit being pending, it is case for consideration of regular bail of the petitioners if they surrender within a period of six weeks in connection with Araria SC/ST P.S. Case No. 03 of 2015 pending in the court of learned ACJM, Araria.

It is expected from the learned court below to dispose of the regular bail application of the petitioners preferably on the same day.

Accordingly, the application is disposed of.
