2. The petitioner apprehends arrest in a case registered under Section 30(a) of Bihar Prohibition and Excise Act.

3. As per prosecution case, 36 liters illicit liquor was recovered from the cottage type Bathan of the petitioner.

4. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case merely on suspicion. Further submission is that petitioner has no concern with the seized liquor. Petitioner was not present at the place of occurrence. Nothing has been recovered from the conscious possession of the petitioner. The recovery is made from an open type place

Patna High Court CR. MISC. No.26095 of 2026(2) dt.22-04-2026 2/2 easily accessible to anyone. Petitioner has got no criminal antecedent and he undertakes to cooperate in the investigation and trial.

5. Learned A.P.P. for the State opposed the prayer for bail.

Considering the aforesaid facts and circumstances of the case, submissions of learned counsel for the parties and clean antecedent of the petitioner, let the above named petitioner be released on bail, in the event of arrest or surrender before the Court concerned within a period of six weeks from today, on furnishing bail bond of Rs. 10,000 (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court-II, Siwan, in connection with Siwan Excise P.S. Case No. 531 of 2025, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
