Petitioner is in custody in connection with Minapur P.S. Case No. 336 of 2019 for the offence under sections 272, 273, 419,420, 120(B) of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act. Learned counsel for the petitioner submits that the name of the petitioner was disclosed by Rajeev Sahni who was apprehended with pick-up van carrying 1617.76 liters of foreign liquor.

Leaned counsel submits that the petitioner is in custody since 30.5.2020.

Considering the fact that the petitioner was not apprehended alongwith liquor and his name was disclosed by

No.23425 of 2020(2) dt.16-09-2020 2/2 the person who was apprehended alongwith liquor, the Court is inclined to grant bail to the petitioner subject to the condition that the petitioner shall deposit Rs. 1,00,000/- cash before the court below and on deposit of Rs. 1,00,000/- the court below shall release the petitioner on bail on furnishing bail bond of Rs. 1,00,000/- (One lakh) with two sureties of the like amount each to the satisfaction of learned Special Judge,Excise Act, Muzaffarpur, in connection with Minapur P.S. Case No. 336 of 2019. The amount i.e. Rs. 1,00,000/- deposited by the petitioner shall abide by final outcome of the pending criminal case. (Anil Kumar Upadhyay, J) Ravi/- U T
