JUSTICE DINESH KUMAR SINGH ORAL ORDER 17-12-2015 Petitioner no. 1 Jalil, petitioner no. 6 Akhtar and petitioner no. 9 Bibi Kari have been arrested and their application of anticipatory bail has become infructuous. Accordingly, the application for anticipatory bail of petitioner nos. 1, 6 and 9 is dismissed as withdrawn. Heard learned counsel for the petitioners and the State.
Petitioner nos. 2 to 8 except petitioner no. 6 are apprehending their arrest in a case registered for the offences punishable under Sections 147, 341, 323, 325, 307, 504, 506 of the Indian Penal Code.
Patna High Court Cr.Misc. No.56998 of 2015 (2) dt.17-12-2015 The prosecution case is that 14 accused persons including petitioners came variously armed, when co-accused Muzaffar, Akhtar, Nasim and Mansoor pushed down the son of the informant Md. Yasin on the ground and two persons caught hold of her hand and others two by twisting fractured his hand. The informant, his wife and others went to rescue, then informant and others were assaulted by accused persons.
It is submitted by the learned counsel for the petitioners that there is counter version of the occurrence and specific accusation is not against the petitioners. The injury report has not been corroborated by the medical report. The aforesaid facts constitute ground for consideration of prayer for regular bail of the petitioners, if petitioner nos. 2 to 8 except petitioner no. 6 surrender before the learned court below within a period of six weeks from today in connection with Amor P.S. Case No. 148 of 2015, pending in the court of learned Chief Judicial Magistrate, Purnea. With this observation this application is disposed of.
