JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 27-02-2018 Heard learned counsel for the petitioners and learned counsel for the State.
The petitioners seek pre-arrest bail in connection with Ara Nawada P.S. Case No.348 of 2017 registered under Sections 420, 468, 120B/34 of the Indian Penal Code.
It is submitted by the learned counsel for the petitioners that the land in question had been sold through registered sale deed by the informant on 28.05.1985 in which his brother Siyaram Rai, a co-accused is a witness and now the informant is claiming that he has not sold the land. He submitted that since 1985 the petitioners are in possession of the said land. It has also been mutated in the name of the petitioners and they are paying rent to
Patna High Court Cr.Misc. No.11674 of 2018 (2) dt.27-02-2018 2/2 the State Government.
Considering the nature of allegation and the submissions made above, in the event of arrest or surrender in the court below within six weeks from today, the petitioners are directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Ara, Bhojpur in connection with Ara Nawada P.S. Case No.348 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
