2. The petitioners are apprehending their arrest in connection with Nadi P.S. Case No. 390 of 2024 for the offence under sections 303(2) and 317(2) of the B.N.S., 2023, lodged on 09.12.2024 by the informant, Birendra Prasad.

3. As per the prosecution story, the informant alleged the in course of patrolling when they reached near Vishnu

Patna High Court CR. MISC. No.25518 of 2025(2) dt.07-05-2025 2/3 Temple, found 3-4 persons after parking one colour Tempo, trying to open the Tarpaulin. When they tried to escape, Dilip Kumar was apprehended and he gave the name of Vikash Kumar and Ram Vishwash Kumar as associates. Upon further query, they informed that the articles loaded in the Tempo are theft materials taken out from a Warehousing Express Logistic Godown with the help of Vikash Kumar, Ram Vishwash Kumar and 6-7 other persons for the purpose of selling. As their intent to sell it, they are going to keep these theft materials in the godown near Vishnu Temple but got apprehended. A seizure list was prepared and the FIR was lodged.

4. Both the petitioners claim their innocence and as per the learned counsels, their names have come in the confessional statement of co-accused Ram Vishwash Kumar, actually they do not have no role to play and the Golu Kumar has given his godown to Ram Vishwash Kumar, an associate of Dilip Kumar.

5. Learned APP opposes the prayer submitting that a perusal of the order of learned Sessions Judge would show that the Godown belongs to Golu Kumar and he was in continuous conversation with Ram Vishwash Kumar on the mobile number. Further, so far as the Ajay Kumar is concerned, his name has

6. Taking into account the submissions of the parties as also that they were actively participating in the theft, huge recovery is there from the Tempo, in that background, this Court is not inclined to extend them the privilege of anticipatory bail.

7. Accordingly, the prayer of anticipatory bail of the petitioners stands rejected.
