The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 147, 341, 323, 324, 307, 379, 504 and 427 of the Indian Penal Code. The informant alleges that on 17.06.2020, at about 7:30 pm, the accused persons, including the petitioners, entered his house and started assaulting him with danda and bricks causing injury on his eyebrow and he fell down and when his brother came to rescue him, it is alleged accused Mukesh
Patna High Court CR. MISC. No.27383 of 2023(2) dt.21-07-2023 2/3 assaulted him with bricks on leg and thereafter, Vikas and Pintu fled with some important documents.
Learned counsel for the petitioners submits that the petitioners are persons with clean antecedent and petitioner No. 1 and 4 are women.
Learned counsel for the petitioners submits that the petitioners have been falsely implicated in the present case, it is next submitted that from bare perusal of the allegations as alleged in the FIR, it would manifest that it appears that the occurrence took place on account of dispute relating to land and even the allegation of assault is not specific and the injured has not suffered any injury on vital part of the body. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.
Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Fatehpur
