JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 27-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with C.R. Case No. 54 of 2013 bearing Trial No. 4107 of 2015 registered under Sections-341, 323, 379, 498(A)/34 of the Indian Penal Code.
Petitioner happens to be husband of the complainant and marriage of the petitioner was solemnized with the complainant in the year, 2011. It is alleged that the petitioner used to torture the complainant on account of non-fulfillment of illegal demand of dowry but submission on behalf of petitioner is that within a very short span of time, the complainant deserted the petitioner and started residing at her parental home. Patna High Court Cr.Misc. No.6736 of 2016 (3) dt.27-04-2016 2/2 the complainant got missing and her dead body was recovered in Nepal and for the aforesaid occurrence, Ladaniya P.S. Case No. 03 of 2014 was registered, in which, petitioner and his other family members were granted bail by this court vide order dated 21-042015 passed in Cr. Misc. No. 3389 of 2015 and one analogous case.
Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner named above, in the event of his arrest or surrender in the court below within four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with C.R. Case No. 54 of 2013 bearing Trial No. 4107 of 2015 to the satisfaction of Sri Amit Kumar Pandey, J.M.-Ist Class, Madhubani. (Hemant Kumar Srivastava, J) A.K.V./- U T
