1. Heard learned counsel for the petitioner and learned A.P.P for the State along with learned counsel for the informant.

2. The petitioner has preferred this application for grant of regular bail in connection with Muffasil P.S. Case No. 09 of 2024 dated 05.01.2024 registered for the offences punishable u/s 304(b)/34 of the Indian Penal Code.

3. As per the prosecution case, the petitioner along with co-accused is alleged to have tortured the daughter of the informant due to non-fulfillment of dowry demand upon which the daughter of the informant has committed suicide by hanging herself.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner is 72 years old widow and she is the mother-in-law of the deceased. There is no specific allegation against the petitioner. It

No.29640 of 2024(2) dt.29-04-2024 2/2 is further submitted that during course of investigation, as the postmortem report, no other marks have found on the body of the deceased. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 06.01.2024.

5. Learned A.P.P. for the State and learned counsel for the informant have vehemently opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well as there is no specific allegation against the petitioner who is a lady, the petitioner above-named, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Gaya in connection with Muffasil P.S. Case No. 9 of 2024.

7. The application stands allowed.
