Petitioner apprehends his arrest in connection with Jamo Bazar P.S.Case No. 141 of 2017 registered for the offences punishable under Sections 448, 376, 511, 504, 506 and 323 of the Indian Penal Code.

Allegation against the petitioner is of attempting to commit rape upon the informant.

Submission of learned counsel for the petitioner is that there is delay of 20 days in lodging FIR and petitioner has no criminal antecedent.

Heard learned APP also, who has opposed the prayer for anticipatory bail.

Having heard both sides and in view of allegation, I am

Patna High Court Cr.Misc. No.13009 of 2018 (2) dt.04-04-2018 2/2 not inclined to grant anticipatory bail to the petitioner. Prayer is rejected.

However, petitioner should surrender and pray for regular bail, which shall be considered on its own merit, without being prejudiced by this order.
