The petitioners have preferred this application for grant of regular bail in a case registered under section 30(a) of the Bihar Prohibition and Excise Act, 2016.
As per the prosecution case, 873 litres of liquor is stated to have been recovered from the vehicle of which the petitioners were the driver and khalashi.
It is submitted by learned counsel for the petitioners that the petitioners have been falsely implicated in the case. No incriminating article has been recovered from their possession or vehicle. They are in custody since 26.12.2020 and have no
Patna High Court CR. MISC. No.36635 of 2021(2) dt.24-12-2021 2/2 criminal antecedent. Charge sheet has been submitted in the case.
The application for bail is opposed by learned APP for the State who submits that the petitioners are resident of outside the State of Bihar.
Having heard learned counsel for the parties and taking into consideration the facts of the case specially the petitioners not having any criminal antecedent, the Court directs both the petitioners to be enlarged on bail in connection with G.O. P.S. Case no. 320 of 2020 on each of them furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge II-cum-Special Judge, Nawada, on the condition that one of the bailors of both the petitioners shall be a close relative while the second bailor of both the petitioners shall be resident of a place within the jurisdiction of the learned trial Court.
