The petitioners apprehend their arrest in Hasanpur P.S. case No. 172 of 2017 registered under Section 367, 366, 366(A)/34 of the IPC.

The informant, father of the victim, alleged that his daughter had gone to school but did not return. During the course of inquiry he came to know that Chandan Kumar and his relatives, father, mother, brother, married sister and brother-inlaw kidnapped his daughter. The learned counsel for the petitioners submits that petitioners are married sister and brother-in-law of Chandan Kumar. They are residing in a different village. They have got

Patna High Court CR. MISC. No.27517 of 2019(2) dt.26-04-2019 2/2 no manner of concern with the elopement of the daughter of informant said to have been done by Chandan Kumar. Father and mother of Chandan Kumar, namely, Ram Subhaw Raut and Sulochana Devi, have already been granted anticipatory bail. The case of petitioners stands on better footing inasmuch as they are residing in a village situated away from the place of occurrence and nobody has seen the petitioners in the P.O. village on the day of occurrence.

Considering the facts aforesaid and nature of allegation made against the petitioners, the petitioners, above named, in the event of their arrest/ surrender before the court below within a period of four weeks from the date of receipt/ production of a copy of this order are directed to be enlarged on bail on their furnishing bail bond of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge, Rosera, Samastipur in connection with Hasanpur P.S. case No. 172 of 2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
