Petitioner apprehends his arrest in Bhadaur P.S. Case no. 19 of 2016, instituted for the offence under Section(s) 143, 341,323, 224, 225, 353 and 504 of the Indian Penal Code. In the written report, it is alleged that the police party, on information, has gone to arrest wanted accused Kedar Yadav and arrested him. Thereafter, this petitioner along with other named accused persons and around 150 unknown persons armed with deadly weapon forcibly rescued accused, namely, Keday Yadav.

It is mentioned in para 2 of the bail petition that prayer for anticipatory bail of this petitioner was earlier rejected by a Co-ordinate Bench of this Court vide order dated 23.08.2016

Patna High Court Cr.Misc. No.42144 of 2017(2) dt.30-01-2018 2/2 passed in Cr. Misc. No. 31117 of 2016. The petitioner was directed to surrender in the Court below and make prayer for regular bail. It further transpires that the petitioner has again filed second anticipatory bail petition vide Cr. Misc No. 4335 of 2017 which was dismissed as withdrawn by order dated 15.03. 2017.

This is the third attempt of the petitioner for grant of anticipatory bail.

This Court does not find any fresh ground to grant anticipatory bail to the petitioner. Accordingly, the prayer for anticipatory bail is rejected.

The petitioner is directed to surrender in the Court below within a period of four weeks from the date of receipt/production of a copy of this order and make prayer for regular bail which shall be considered/disposed off on its own merit without being prejudiced by this order.
