Learned counsel appearing for the petitioner submits that although due to illness and paucity of money, the petitioner could not make payment as directed by this Hon'ble Court, however, as of now petitioner has paid the entire due amount of Rs. 10,20,000/- as is evident from the marginal note of acceptance of the informant at the order sheet which has been brought on record as Annexure-7.

Considering the facts and circumstances of the case, it

Patna High Court CR. MISC. No.34806 of 2019(2) dt.19-06-2019 2/2 is directed that in case petitioner moves an application before the Court below, the Court below shall consider and dispose of the same on the same day, if possible, after verifying the statement of the petitioner that he has already paid the due amount.

This application, thus, stands disposed of.
