The petitioner apprehends his arrest in a case under Sections 420, 409, 471 of the Indian Penal Code. The petitioner was the PACS Chairman of West Thekha and it is alleged that in the year 2013-14, the petitioner purchased paddy after receiving false rent receipts and land possession certificates from the farmers. It is alleged that the petitioner purchased paddy from different farmers, who gave rent receipts and blank land possession certificates and the petitioner paid price of purchased paddy through cheques which were credited in the account of the farmers. The petitioner had no opportunity to verify the genuineness of the rent receipts and the land possession certificates issued by the concerned authority. There is no allegation of misappropriation of any land. Entire

Considering the facts aforesaid, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Sadar Motihari, East Champaran in Muffasil P.S. Case No. 178/2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
