====================================================== CORAM: HONOURABLE MR. JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 02-08-2024 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

2. The petitioner is apprehending his arrest in connection with Guraru P.S. Case No. 218 of 2022 dated 21.11.2022 registered for the offences punishable under Sections 147, 461, 323, 307 and 120B of the I.P.C.

3. As per the prosecution case, the petitioner and the co-accused persons are alleged to have assaulted the informant's mother with iron rod due to which her head was injured and her hand was fractured.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has been falsely implicated in this case. There is general and omnibus allegation against the

Patna High Court CR. MISC. No.34605 of 2024(2) dt.02-08-2024 2/2 petitioner. The specific allegation of assault on the informant's mother is against the co-accused Anand Kumar and as per the injury report the said injury is grievous in nature. The other coaccused persons have already been granted bail by a Bench of this Court vide Cr. Misc. No. 76132 of 2023 under order dated 18.12.2023, annexed as Annexure-P/2 to the present bail application. The petitioner has clean antecedent as stated in paragraph no. 3 of the bail application.

5. Learned A.P.P. for the State has opposed the prayer for anticipatory bail of the petitioner.

6. Considering the aforesaid facts and circumstances of the case, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on anticipatory bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned J.M. Ist Class, Gaya in connection with Guraru P.S. Case No. 218 of 2022, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.

7. The application stands allowed.
