The petitioner apprehends his arrest in connection with Jamhore P. S. Case No. 43 of 2017 instituted under Sections 406 and 420 of the Indian Penal Code and Section 40 of the Bihar Minor Mineral Concession Rule, 1972.
Allegation is that petitioner was running a brick kiln without having any licence or no objection certificate from Pollution Control Board.
Submission is that petitioner had a valid licence for this year and for renewal of the licence, he has also made on-line payment of Rs. 42,300/- and another co-accused, being also brick kiln owner, Suresh Mehta, has been granted anticipatory bail by a co-ordinate Bench of this Court by order dated 3.10.2017 in Cr.
Patna High Court Cr.Misc. No.49997 of 2017 (2) dt.17-10-2017 2/2 Misc. No. 46002 of 2017 and the case of this petitioner stands on similar footing.
Having considered the aforesaid facts and circumstances, let the petitioner, namely, Pramod Kumar Singh, in the event of arrest or surrender before the court below within four weeks from today, be released on bail upon furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Jamhore P.S.Case No. 43 of 2017; subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
