Petitioner is apprehending his arrest in connection with Sabour P.S.Case No.214 of 2018 dated 7.7.2018 , registered for offences punishable under Sections 406, 409 and 420 of the Indian Penal Code.

Allegation against the petitioner is that she along with another co-accused Smt. Sharda Devi without technical sanction and administrative sanction has taken Rs.5,50,000/- and Rs.7,500/- by cheques and further allegation is that by forged signature of the Receiving Clerk, she has deposited the cheques.

Submission of the learned counsel for the petitioner is that as per the Government Circular, for the work up to the

Patna High Court CR. MISC. No.31727 of 2019(2) dt.24-07-2019 2/2 amount of Rs.15,00,000/- , the Junior Engineer is competent authority for grant of technical sanction and the technical sanction & the administrative sanction have already been granted before releasing of the cheques and she has completed the works as per specification and considering these facts, coaccused, Smt. Sharda Devi has been granted privilege of anticipatory bail, vide order dated 11.1.2019 passed in Cr. Misc. No.78841 of 2018.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the learned court below, be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Bhagalpur in connection with Sabour P.S.case No.214 of 2018 dated 7.7.2018, subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
