This application, for grant of anticipatory bail, arises out of Chakai P.S. Case No. 173 of 2016, disclosing offences under Sections 147, 148, 149, 323, 324, 341, 342, 307, 337, 427 and 504 of the Indian Penal Code. Altogether 16 persons have been named in the First Information Report. It is clear from the First Information Report that land dispute is the reason behind the alleged occurrence. The allegation against individual accused persons is not specific. The petitioners belong to the same family.

Considering the facts and circumstances of the case, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-II, Jamui, in connection with Chakai P.S. Case No. 173 of 2016, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure. This is subject to the condition that the petitioners shall present themselves before the police/Court, as the case may be, as and when required

Patna High Court Cr.Misc. No.43012 of 2017 (2) dt.20-09-2017 3/3 and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
