The petitioner is in judicial custody in connection with Hajipur Town P.S. Case No. 349 of 2021 for the offences under Sections 307/34 of the Indian Penal Code section 27 of the Arms Act.

Manju Devi, the mother of the deceased lodged the FIR alleging that while they were participating in a marriage ceremony, her daughter-in-law informed about her son having been shot at by the three accused persons. When she came to the house, saw her son in injured condition and upon enquiry, he

Patna High Court CR. MISC. No.28122 of 2022(2) dt.06-09-2022 2/2 informed that Vijay Kumar Chaudhary (the petitioner herein) fired upon him and fled away.

Considering the fact that there is direct allegation against the petitioner coming from the mouth of the deceased as narrated to his mother (informant), this Court is not inclined to grant him privilege of bail which is accordingly rejected. The Trial Court is hereby directed to conclude the trial preferably within a period of one year.
