The petitioners apprehend their arrest in Sahiyara P.S. Case No. 61/2011 for the offence punishable under Section 302/34 of the Indian Penal Code.
Allegation has been made that the son of the informant had gone along with Ram Chandra Thakur and Shyam Chandra Thakur, but did not return. Thereafter, on the next day dead body of her son was found in field.
Considering the facts aforesaid, I am not inclined to enlarge the petitioners above named on anticipatory bail. Accordingly, the same is rejected.
If the petitioners surrender before the court below within four weeks from today and pray for regular bail, his prayer
Patna High Court Cr.Misc. No.41405 of 2017 (2) dt.10-10-2017 2/2 shall be considered on its own merit without being prejudiced by this order.
