JUSTICE BIRENDRA PRASAD VERMA ORAL ORDER 27-10-2016 Despite repeated calls, none appears on behalf of the petitioner in support of the present writ petition, though the names of the learned counsel appearing on his behalf are printed in the daily cause list. However, I have heard the learned GA-3 appearing on behalf of the respondent no.1 and the learned counsel appearing on behalf of the respondent nos.2 to 4, who have entered appearance suo motu.

The petitioner has filed the present writ petition with a prayer for quashing the entire proceeding of Land Dispute Case No.100 of 2013-14 pending before the D.C.L.R., Sadar Patna. The learned counsel appearing on behalf of the respondent nos.2 to 4 submits that in the aforesaid Land Dispute Case No.100 of 2013-14 now final order has been passed on 22.01.2015. Therefore, the present matter has become infructuous. He has produced a photocopy of the order dated 22.01.2015

Patna High Court CWJC No.12519 of 2014 (2) dt.27-10-2016 passed by the D.C.L.R., Patna Sadar in Land Dispute Case No.100 of 2013-14. Let a copy of the aforesaid order be placed on the record.

In view of the fact that the final order has been passed in the impugned proceeding, the present matter has become infructuous. It is, accordingly, dismissed.

However, the petitioner, if so advised, shall be at liberty to file an appeal against the aforesaid final order before the prescribed appellate authority.
