The petitioners are apprehending their arrest in connection with Sirdala P.S.Cae no.38 of 2016 registered for offences punishable under Sections 420, 409 and 34 of the Indian Penal Code.
Allegation against the petitioners is of defalcation of Rs.2,40,000/- and odd allotted for construction of the building in the School. Petitioner no.1 is the Incharge Principal and the petitioner no.2 is the Secretary of the School. Submission of the learned counsel for the petitioners that the petitioners have completed the work and nothing was due with them and if the measurement is done, the same will appear. Heard learned A.P.P. also.

No.10873 of 2018 (2) dt.27-02-2018 2/2 Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioners surrender within a period of six weeks and the learned court below shall release the petitioners on provisional bail on bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each for a period of three months and in the meantime, the authority concerned will make final measurement of the work and even if the dues are found against them, the petitioners shall deposit the same, otherwise their bail bond shall be cancelled and if there is no dues against them, their bail bond shall be confirmed. With the aforesaid observation, this application is disposed of.
