JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-05-2019 Petitioner seeks regular bail in connection with Kuchaikot P.S. Case No.288 of 2018 registered for the offences punishable under Sections 302, 201, 365 and 34 of IPC. Prosecution story is that son of the informant, namely, Govind Mahto has gone to see the procession and thereafter, he did not return and inspite of search, he was not found, later on, his dead body was found. Petitioner is not named in the F.I.R., later on his name transpires during the investigation Submission of the learned counsel for the petitioner is that he has made accused only on the basis of the fact that he was in contact with other accused persons accompanying the deceased. Apart from that there is no other allegation against the petitioner and he is in custody for about five months and the charge sheet has already been submitted as such, there is no

Having heard both sides, in view of the facts and circumstances, as stated above, let the petitioner above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned 07the Additional Chief Judicial Magistrate, Gopalganj, in connection with Kuchaikot P.S. Case No.288 of 2018, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned.
