The petitioners seek pre-arrest bail in connection with Chainpur P.S. Case No. 266 of 2017 registered under Sections 341, 323, 307 and 504 read with 34 of the Indian Penal Code.
It is submitted by the learned counsel for the
Patna High Court Cr.Misc. No.11700 of 2018 (2) dt.27-02-2018 petitioners that there is a case and counter case and so far as the petitioner nos. 2 to 6 are concerned, there is no allegation that they committed any overt act in the alleged occurrence of offence. It is submitted that the injury alleged to have been caused by petitioner no.1 Mallu Yadav to Bablu Yadav was found simple in nature by the doctor who examined him. Having regard to the nature of allegation and the submissions made above, in the event of arrest or surrender in the court below within six weeks from today, the petitioners, who are reported to have no criminal antecedent, are directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-II, Kaimur at Bhabua in connection with Chainpur P.S. Case No. 266 of 2017 subject to the conditions as laid down under Section 438(2) Cr. P.C. (Ashwani Kumar Singh, J.) Sanjeet/- U T
