Permission is accorded.

Accordingly, the application with regard to petitioner no.2 Karu Prasad is dismissed as withdrawn.

Heard learned counsel for petitioner no.1 Mahendra Prasad and learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Ekangarsarai P.S. Case No.128 of 2022 registered under Section 307 of the Indian Penal Code and other allied sections of the I.P.C.

Patna High Court CR. MISC. No.27470 of 2023(2) dt.07-07-2023 2/2 Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. There is a case and counter case between both sides and both parties have sustained injuries. The petitioner has got no criminal antecedent.

Having considered the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the above named petitioner no.1 Mahendra Prasad be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of A.C.J.M., Hilsa (Nalanda) in connection with Ekangarsarai P.S. Case No.128 of 2022, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
