JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-07-2019 This is an application for grant of anticipatory bail in connection with Samastipur (M) P.S. Case No. 3 of 2019, disclosing offences under Sections 302, 120B of the Indian Penal Code and Section 27 of the Arms Act.
Prosecution story is that one Ramesh Thakur has called her husband for taking Rs.40,000/- from Amarjeet Sahni, which was given to him on interest and thereafter, the accused persons took liquor and took her husband on the motorcycle to unknown place and after sometime, she got an information that her husband has been murdered.
Submission of the learned counsel for the petitioner is that he has falsely been implicated in this case. Except suspicion nothing against him and the F.I.R. itself shows that one Amarjeet Sahni and Ramesh Thakur has taken the deceased and
Patna High Court CR. MISC. No.24331 of 2019(3) dt.03-07-2019 2/2 later on, her husband was murdered.
Further submission is that one of the co-accused having similar allegation has been granted anticipatory bail vide order dated 18.06.2019 in Criminal Misc. No. 18673 of 2019 by a Co-ordinate Bench of this Court.

Having heard both sides, in view of the facts and circumstances, as stated above, the provisional bail granted to the petitioner vide order dated 19.04.2019 is confirmed. (Vinod Kumar Sinha, J) Sunil Shukla/- U T
