ANJANA PRAKASH ORAL JUDGMENT Date: 04-02-2015 The Petitioner seeks appointment on the basis of a proposal for appointment of the Petitioner on the post of Chaukidar. He submits that after the proposal work was entrusted to him but subsequently he was disengaged on the ground that son of previous Chaukidar had been given appointment on the ground of compassion. Counter Affidavits have been filed by the Respondents stating therein that the Petitioner was never appointed nor his services were regularized and if, at all, work was taken he was only a casual labourer.
Since there is nothing on record to show that the Petitioner was ever appointed, this Court finds it difficult to grant any
Patna High Court CWJC No.15887 of 2006 dt.04-02-2015 2/2 relief to the Petitioner.
The application is disposed off with liberty to the Petitioner to file a representation before the authorities concerned which shall consider as to whether any work was taken from the Petitioner between the period that he claims to have worked i.e. from 15.04.1988 to 31.12.2004 and pay such remuneration as permissible under law. Such a decision by the authorities should be taken within four months.
The application stands disposed off with the aforesaid observation.
