The petitioner seeks bail in Rajpur P. S. Case No. 214 of 2018 instituted for the offence under Section(s) 147,148, 341,323, 332, 353, 506 of the Indian Penal Code and section 37( c) of the Bihar Excise (Amendment) Act, 2018. It is alleged in the written report that this petitioner in intoxicated state of mind along with Md. Ali Sher Sah, Member, Panchayat Samiti, Barupur along with ten unknown persons variously armed with weapons started scattering the registers and documents of the Block office premises and also abusing the Block Development Officer and assaulted the employees of the Block with fist and slap and also gave them threat to kill. From the written report itself it appears that there is
Patna High Court CR. MISC. No.28633 of 2019(2) dt.02-05-2019 2/2 general and omnibus allegation levelled against this petitioner. Learned counsel submits that case has also been compromised between the parties. The compromise petition has been filed in the Court below which is annexed as Annexure-2 to bail petition.
Petitioner is in custody since 8.3.2019.
Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the Addl. Sessions Judge cum Spl. Judge Excise Buxar in connection with Rajpur P. S. Case No. 214 of 2018 subject to the condition that both the bailers shall be the close relative of the petitioner.
