The petitioner apprehends his arrest in connection with Special Case No. 6A of 1997 (Vigilance P.S. Case No. 4 of 1997) instituted under Sections 420, 467, 468, 471, 477A, 120B of the Indian Penal Code read with Section 5(i)(d) of the Prevention of Corruption Act, 1947 corresponding to Section 13(2) read with Section 13(1)(d) of the Prevention of Corruption Act, 1988. The allegation, in brief, is that many officials including the petitioner, at the relevant point of time, being Special Land Acquisition Officer, made irregular/illegal appointments to the Class-IV employees.

It is submitted that charge sheet was submitted in the

Patna High Court Cr.Misc. No.39017 of 2017 (5) dt.17-10-2017 2/2 year 2007and cognizance of offence has been taken by the court but no notice has been served to the petitioner. Petitioner has retired way back long and at present he is 82 years old and other co-accused, namely, Awadhesh Kumar Singh has been granted anticipatory bail by a co-ordinate Bench of this Court vide order dated 01.10.2008 in Cr. Misc. No. 27225 of 2008. Having considered the aforesaid facts and circumstances, let the petitioner, namely, Vinesent Barahi Toppo in the event of arrest or surrender before the court below within four weeks from today, be released on bail upon furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Vigilance 1st, Patna in connection with Special Case No.

6A of 1997 (arising out of Vigilance P.S. Case No. 4 of 1997); subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure, 1973 with direction that petitioner shall be present before the trial court on each and every date, subject to non-appearance due to illness otherwise, his bail bond shall be liable to be cancelled.
