The petitioner has preferred this application for grant of regular bail in a case registered under section 307 and other sections of the Indian Penal Code to which section 302 of the Indian Penal Code was added subsequently.

As per the prosecution case, over a trivial dispute which had taken place a day earlier it is stated that the six named accused persons including the petitioner herein came variously armed. While one Lalu Tanti is stated to have assaulted the father of the informant, the other accused persons assaulted the informant and others.

It is submitted by learned counsel for the petitioner that the allegations against the petitioner are general and

Patna High Court CR. MISC. No.36849 of 2021(2) dt.05-01-2022 2/2 omnibus in nature. He has been falsely implicated in the case. The father of the informant died subsequently. In the F.I.R. the allegation of assault on the father of the informant is solely against Lalu Tanti. The petitioner is in custody since 12.1.2021 and has no criminal antecedent.

Having heard learned counsel for the parties and taking into consideration the facts of the case, the general allegations against the petitioner together with the petitioner having remained in custody for over 11 months and chargesheet having been submitted in the case, the Court directs the petitioner to be enlarged on bail in connection with Sabour P.S. Case no.16 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhagalpur.
