The petitioner is apprehending his arrest in a case registered under Sections 467, 468, 420 and 120B of the Indian Penal Code.

Allegation is that the accused persons after making conspiracy created forged and fabricated document and sold the land to other persons and cheated the complainant with ill motive to grab his land.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of

Patna High Court Cr.Misc. No.51120 of 2016 (2) dt.02-12-2016 2/2 tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. The matter relates to civil dispute. The other co-accused have been granted anticipatory bail vide Annexure-2 to the present application.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st class, Saharsa in connection with Complaint case No.1752C of 2013, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
