The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 363, 365/34 of the Indian Penal Code.

It is alleged that the petitioners came to the house of the informant, took his daughter Kumari Anamika Priya to their house on the pretext that her mother is calling. When the victim did not return, the informant went to the house of the petitioners, when the informant was abused. It is further alleged that Anita Devi called on mobile of Anand Mohan Kumar and forbade to disclose anything. After that informant went to the house of Raushan Kumar and Chandan Kumr and with the help of mobile phone of Raushan Kumar victim was recovered

It is submitted by the learned counsel for the petitioners that the victim is maternal sister of the petitioners and due to petty dispute accusation has been levelled, though the victim on recovery not alleged anything against the petitioners. In 164 Cr.P.C. statement victim only said that she was being called by the petitioners. Subsequently, mother of the petitioner fed her something, as a result she got intoxicated. It is further submitted that the victim has not received any injury. The petitioners are unmarried girl. Considering the fact that the petitioners are unmarried girl, let the above named petitioners be released on bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, West Muzaffarpur in connection with Saraiya P.S. Case No. 337 of 2015, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
