This application has been filed by the petitioner for modification in the order dated 04.12.2017 passed in Criminal Misc. No. 23158 of 2017 by this court with regard to extend the period of surrender of the petitioner in the court below. Learned counsel for the petitioner submits that vide order dated 04.12.2017 passed in Criminal Misc. No. 23158 of 2017, the petitioner was ordered to be released on bail, in the event of arrest or surrender before the court below, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial

Patna High Court CR. MISC. No.26708 of 2019(2) dt.15-05-2019 2/2 Magistrate, Aurangabad, in connection with Obera P.S. Case No. 108 of 2016, subject to the conditions laid down under Section 438(2) Cr.P.C. But the petitioner could not surrender within the stipulated period due to personal difficulties. In that view of the matter, learned counsel for the petitioner prays for extension of period of surrender of the petitioner in the court below.

Considering the submission of the learned counsel for the petitioner, the period of surrender of the petitioner in connection with the aforesaid case in the court below is further extended for four weeks from today and this applications is, accordingly, allowed with the aforesaid modification in the order dated 04.12.2017 passed in Criminal Misc. No. 23158 of 2017.
