JUSTICE ASHUTOSH KUMAR ORAL ORDER 31-08-2020 Mr. Prince Kumar Mishra, learned counsel for the petitioner, after some arguments seeks permission to withdraw this petition in order to enable the petitioner to approach the concerned authority for release of 62 bags of rice which is said to have been seized by the Block Supply Officer, Sahdei Buzurg, Hajipur at Vaishali leading to the registration of FIR viz. Desari P.S. Case No. 77 of 2020 dated 14.04.2020 instituted for the offences under Section 7 of the Essential Commodities Act and Sections 420 and 34 of the Indian Penal Code. The prayer is allowed.

The petition is dismissed as withdrawn with the liberty aforesaid.

In case such a petition is filed before the concerned authority, the same shall be disposed of within a reasonable period of time without being prejudiced by the fact that the present petition for release has not been entertained.
