JUSTICE BIRENDRA KUMAR ORAL ORDER 21-09-2017 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

The petitioners are apprehending their arrest in a case registered for the offence punishable under Section 304B of the Indian Penal Code.

The petitioners are relations of the husband. The mother-in-law has already been allowed anticipatory bail by a Coordinate Bench of this Court vide order dated 24.05.2017 passed in Cr. Misc. No. 13770 of 2017 for the reason that material came during investigation that the victim committed suicide due to some dispute with her husband and not due to torture for non-fulfillment of dowry demand. Considering the aforesaid facts, let the petitioners,

Patna High Court Cr.Misc. No.34759 of 2017 (3) dt.21-09-2017 2 /2 above named, in the event of their arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bonds of Rs.20,000/- (Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran at Chapra/successor Court in connection with Dariyapur Police Station Case No. 16 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioners shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners.
