Perused the report of the Superintendent of Police, Lakhisarai.
Learned counsel for the petitioner has categorically submitted before this Court that the petitioner is ready to pay a sum of Rs. 5000/- per month to opposite party no. 2. His only anxiety is that the sum of Rs. 5000/- per month be the total amount including the payments which have already been made to opposite party no. 2.
It is submitted that earlier the petitioner had been paying Rs. 2000/- per month to the applicant- opposite party no. 2 in terms of the order of learned Additional Sessions Judge, Lakhisarai in ABP No. 517(L)/2013. This amount shall remain

Learned counsel for the opposite party no. 2 duly agrees that the opposite party no. 2 would be contented with a sum of Rs. 5000/- per month and the same will be the total amount of maintenance including the sum of Rs. 2700/- which had been allowed while granting anticipatory bail to the petitioner and any other amount in another proceeding. The Superintendent of Police, Lakhisarai has informed this court that the petitioner has given in writing to deduct total outstanding amount of Rs. 2,55,000/- payable to opposite party no. 2 in three installments of Rs. 85,000/- each. The first installment of Rs. 85,000/- has already been transmitted to O.P. No. 2 on 16.08.2022. As agreed by learned counsel for the petitioner the two other installments shall be paid within one year from today.
This Court directs that the next installment must be paid on or before 16th of February, 2023 and the last one will be deposited in the account of opposite party no. 2 on or before 16.08.2023. The Superintendent of Police, Lakhisarai shall ensure that such deductions be made from the salary of the petitioner and be remitted to opposite party no. 2 every month. The petitioner has undertaken to pay the current
Patna High Court CR. REV. No.382 of 2018(5) dt.17-08-2022 3/3 maintenance of Rs. 5000/- per month to opposite party no. 2 out of his salary account itself. So long as he is in service, the Superintendent of Police, Lakhisarai shall ensure that Rs. 5000/- per month is deducted from his salary and the same be remitted to opposite party no. 2 every month.
