Heard learned counsel for petitioner nos.2 and 3 and learned A.P.P. for the State.
Petitioner nos.2 and 3 apprehend their arrest in connection with Dandkhora P.S. Case No.85 of 2022 registered under Sections 363, 366(A), 341, 323, 385, 504, 506 and 34 of the Indian Penal Code.
Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in this
Patna High Court CR. MISC. No.27635 of 2023(3) dt.07-07-2023 2/2 case. It is further submitted that the F.I.R. has been lodged after 53 days of the alleged occurrence. The petitioners have got no criminal antecedent.
Having considered the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the above named petitioner nos.2 and 3 be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing personal bonds to the satisfaction of Chief Judicial Magistrate, Katihar in connection with Dandkhora P.S. Case No.85 of 2022, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Arvind Srivastava, J) Harish/- U T
