On 29.07.2022, the following order was passed: "This matter is heard via video conferencing.
None appears.
Matter is of the year 2010. In the instant petition, petitioner has prayed for the following reliefs:-
(1) For issuance of an appropriate direction/directions writ/writs in the nature of mandamus commanding the respondents to make a proper place of posting of the
Patna High Court CWJC No.3234 of 2010(6) dt.29-08-2022 2/3 petitioner and thereby make the payment of entire salary which is due to him since 1993.
(2) For further holding and declaring that the petitioner is continuing on his post pursuant to his joining in the Directorate, Health Department, after getting relieved from the Primary Health Centre, Goroul (Vaishali), especially keeping in view that the concerned competent authority has not passed any adverse orders in this regard.
(3) For any other ancillary relief/reliefs for which the petitioner may be found entitled in the facts and circumstances of the case.
In support of the aforesaid relief, the petitioner is stated to have submitted representation dated 12.01.2010. Respondent - Secretary, Health Department, Government of Bihar is hereby directed to pass speaking order and place in on record before the next date of hearing failing which adverse order would be passed.
Re-list this matter on 29.08.2022."
Today learned counsel for the respondent - State submitted that on 27.08.2022 an order has been passed pursuant to the representation of the petitioner dated 12.01.2010. Copy of the order dated 27.08.2022 shall be made
Patna High Court CWJC No.3234 of 2010(6) dt.29-08-2022 3/3 available to the petitioner's counsel and so also communicate to the petitioner within a period of one week from today. With the above observation, petition stands disposed off, reserving liberty to the petitioner to question the validity of the order dated 27.08.2022, if any.
