JUSTICE DINESH KUMAR SINGH ORAL ORDER 17-12-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 307, 504, 447 and 506 of the Indian Penal Code and Section 27 of the Arms Act.
The prosecution case is that the son of the informant was killed by co-accused Chandraket Singh and his son for which Madhuban P.S. Case No. 119 of 2012 was registered and in the same sequence on 25.01.2013, Chandraket Singh, Raushan Singh, Abhishek Singh, Maya Singh and the petitioner came armed with gun when Chandraket Singh ordered to kill and fired but it did not cause any injury when the father of the informant was also assaulted by the accused persons.
It is submitted by learned counsel for the petitioner that
Patna High Court Cr.Misc. No.56926 of 2015 (2) dt.17-12-2015 2/2 neither the petitioner was named in the earlier case no any specific overt act is alleged against the petitioner in the present case. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent.
Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned J.M., 1st Class, Sikarahna at Motihari, East Champaran in connection with Madhuban P.S. Case No. 12 of 2013, subject to the conditions as laid down under Section 438(2) Cr.P.C.
