The petitioner seeks pre-arrest bail in connection with Madanpur P.S. Case No. 133 of 2015 registered under Sections 409 & 420 read with 34 of the Indian Penal Code. It has been contended that the petitioner is in active service since more than two decades and there is no allegation that he ever misused or abused his official position. The instant FIR has been instituted on the basis of vague allegation. It is further contended that the petitioner has got roots in the society and is not likely to abscond or tamper with the evidence. Learned counsel for the State has opposed the

Regard being had to the facts and circumstances of the case, in the event of arrest or surrender in the court below within six weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad in connection with Madanpur P.S.
