This application for anticipatory bail arises out of Ghoshi P.S. Case N0. 88 of 2016, disclosing offences under Section 409 of the Indian Penal Code.
Petitioner at the relevant point of time, was working as Panchayat Secretary of Gram Panchayat, Uber and Parawan. Allegedly, he failed to make available to the Vigilance officials, necessary files which were required to them for the purpose of investigation into fraudulent payments made as Panchayat Sikshak.
Learned counsel appearing on behalf of the petitioner has submitted that out of seven persons made accused in the First Information Report all have been granted anticipatory bail. He has also submitted that it is

No.48646 of 2017(2) dt.10-11-2017 2/2 not the allegation in the First Information Report despite being in possession over any document, the petitioner refused to make available the Vigilance officials. Considering the above submission and the submission that the petitioner shall make himself available for the enquiry and trial as and when required, this application is allowed.
Let the petitioner above named in the event of his arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Jehanabad in Ghoshi P.S. Case No. 88 of 2016, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
