JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-04-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 25(1-B)A and 26 of the Arms Act.
One country made loaded pistol and three live cartridges were recovered from conscious possession of the petitioner for which petitioner is in jail custody since 06.07.2018.
Para 3 of the petition goes to show that petitioner does have criminal antecedent of near about six cases. It is evident from perusal of written report that when petitioner was arrested by the informant, he disclosed that since he was made accused
Patna High Court CR. MISC. No.24642 of 2019(2) dt.18-04-2019 2/2 in several cases and he has threat to his life, he had kept the seized pistol and live cartridges for safety of his life. Considering the aforesaid facts and circumstances as well as submissions of the parties and period of detention of the petitioner in jail custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Dalsingsarai, Samastipur in conneciton with Dalsingsarai P. S. Case No. 186 of 2018.
