The petitioners have preferred this application for grant of regular bail in a case registered under sections 272, 273 and 34 of the Indian Penal Code and section 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per the prosecution case, a total of 200 litres of liquor is stated to have been recovered from the house of two petitioners.

It is submitted by learned counsel for the petitioners that they have been falsely implicated in the case. No incriminating article has been recovered from their possession or their house. They have no criminal antecedent and are in custody since 19.2.2021. Chargesheet has been submitted in the

Patna High Court CR. MISC. No.36640 of 2021(2) dt.03-01-2022 2/2 case.

Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the facts of the case, the petitioners being in custody for more than 10 months and not having any criminal antecedent, the Court directs the two petitioners to be enlarged on bail in connection with Daudpur P.S. Case no.35 of 2021 on each of them furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Additional Sessions Judge-cum-Special Judge, Excise, Saran.
