The Petitioner has sought a writ of mandamus for direction to the respondents to appoint him as Class IV employee on the basis of the merit list. He submits that the persons, who were below in the serial of the merit list have been appointment, whereas, the Petitioner was not considered.

Counter Affidavit has been filed stating therein that in the category to which the Petitioner belongs he had been considered and the persons, who were lower in the serial of the merit list have been given precedence on account of reservation policy.
