The petitioner is languishing in custody for the offences punishable under Section 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

For land dispute co-accused Ajit Prasad allegedly fired at the husband of the informant causing injury and death. The petitioner and two other named accused were also along with Ajit Prasad. However, no overt-act is alleged against the petitioner. The petitioner is in custody since 14.02.2018. Investigation of the case is complete.

Considering the aforesaid fact, let the petitioner, above named, be released on bail on furnishing bail bond of

Patna High Court CR. MISC. No.27149 of 2019(2) dt.25-04-2019 2/2 Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with S.T. No.452 of 2018, arising out of Mehadiganj P.S. Case No.12 of 2018, with condition that petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
