JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 01-02-2021 Heard Mr. N.K.Agrawal learned senior counsel appearing on behalf of the petitioner and Mr. Parmeshwar Mehta, learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Katihar Mufassil P.S. Case No. 21 of 2020 for the offences under Sections 302, 307, 326/34 IPC.

Mr. N.K. Agrawal, learned senior counsel appearing on behalf of the petitioner submits that no independent witness has supported the prosecution case. He further submits that there is motive behind false implication because the informant side were involved in killing the brother of this petitioner. The petitioner is in custody since 18.1.2020.
