The petitioner has preferred this application for grant of regular bail in a case registered under sections 30(a), 32(2) and 41(1) of the Bihar Prohibition and Excise Act, 2016. As per the prosecution case, a total of 3611 litres of liquor is stated to have been recovered from a truck and a Scorpio vehicle and the accused were taken into custody. It is further stated that on enquiry, it transpired that the said liquor belonged to the petitioner herein and one another. It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from the petitioner's possession who has been falsely implicated in the case because of his antecedents. Patna High Court CR. MISC. No.36655 of 2021(2) dt.04-01-2022 2/2 either with the seized liquor nor with the two vehicles from which liquor was allegedly recovered. The petitioner is in custody since 5.2.2021 and chargesheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the facts of the case together with the petitioner having remained in custody for about 11 months, the Court directs the petitioner to be enlarged on bail in connection with Vaishali P.S. Case no.226 of 2019 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Additional Sessions Judge-cum-Special Judge, Excise Court, Vaishali.
