JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02/ 06.12.2016 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State. Petitioner apprehends his arrest in connection with a case registered under section 307 and other minor sections of the Indian Penal Code.
Fardbeyan of the informant goes to show that it were co- accused Anil Kumar and Ganja Mandal who gave farsa blow to the informant causing head injury to him. So far as the petitioner is concerned, it is alleged that he assaulted the wife of the informant with fists and slaps and snatched her belongings and also showed pistol to her.
The impugned order of the learned Sessions Judge shows that it was the petitioner who assaulted the informant by means of Farsa causing injury to him. The aforesaid finding of learned Sessions Judge appears to be error on the record.
Patna High Court Cr.Misc. No.44792 of 2016 (2) dt.06-12-2016 Considering the aforesaid facts and circumstances as well as submissions of the parties, in the event of arrest/ surrender within six weeks from the date of receipt of this order to the concerned court, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate, Darbhanga in Hayaghat P.S. Case no. 02/2016 subject to condition as laid down under section 438(2) of the Cr.P.C.
