JUSTICE MADHURESH PRASAD ORAL JUDGMENT Date : 08-04-2019 The short submission made by learned senior counsel for the petitioner is that in light of the order dated 19.08.2013 passed in C.W.J.C. No. 2790 of 2011, petitioner's claim for promotion as Inspector and higher posts of Assistant Technical Officer has to be considered on the basis of the gradation list published on 01.08.2006. For the said claim he has made an application before the Director, Animal Husbandry Department, Government of Bihar on 10.09.2013. He prays that if the matter is considered then in all likelihood the petitioner on account of his position in the gradation list of 01.08.2006 would be entitled to the promotion on the higher posts.
The issue raised by the petitioner's counsel is to be
Patna High Court CWJC No.12493 of 2014 dt.08-04-2019 2/2 considered by the respondent no. 3. The representation has been pending since last more than five and half years. In the circumstance, this Court would direct that the claim of the petitioner raised in the representation dated 10.09.2013 be considered expeditiously and without any undue delay by the respondent no. 3 by a reasoned and speaking order within a period of three months from the date of receipt/production of a copy of this order.
If the petitioner is found entitle to the claim, it is needless to say that the benefits be given within the aforesaid period. The rejection of the claim is required to be by a written order assigning reasons in support of the decision and in accordance with law.
Writ petition is disposed off.
